Apply for a review of premises licence

Details

A responsible authority or any other person may apply for a review of a licence or certificate that is in force.

An application form can be found below. There is no fee for this application.

Only review applications that relate to at least one of the four licensing objectives can be considered:

  • The prevention of crime and disorder
  • Public safety
  • The prevention of public nuisance
  • The protection of children from harm

Review applications must clearly relate to the premises for which the review application is being made.

The licensing authority may reject any ground for a review it considers to be frivolous, vexatious or repetitious, or if the grounds cannot be attributed to the operation of the premises concerned.

Applicants calling for a review cannot apply for a review anonymously.

Notify the licence holder and responsible authorities

The person or body requesting the review must also notify the holder of the premises licence or club premises certificate and each responsible authority of their request, by sending them a copy of the application, together with any accompanying documents, on the same day as the application is given to the licensing authority.

Consultation

The licensing authority will arrange for the display of a notice of the application for review on or adjacent to the premises for a period of 28 days during which any responsible authority or other person may make a representation about the application.

Hearings

The licensing authority are required to hold a hearing within 20 working days following the end of the consultation period.  The Licensing sub-committee must then decide how to proceed in order to promote the licensing objectives. It may:

  • Decide that no action is appropriate to promote the licensing objectives
  • Modify or add conditions to the licence
  • Exclude a licensable activity from the licence
  • Remove the designated premises supervisor
  • Suspend the licence for a period of time (not exceeding 3 months)
  • Revoke the licence
