1. We are seeking a copy of a letter we understand has been sent to Wokingham Borough Council, raising issues in relation to planning application 203098. The letter is held by the Council and has been the subject of recent discussions with planning case officer Mr Simon Taylor.

The Council are applying Section 41 (Information provided in confidence) and Section 42 (Legal Professional Privilege) to the letter received. Individuals have a level of expectation when contacting the Council in this manner that their communication will not be provided to a third party or published publicly. Planning Enforcement complaints do have a quality of confidence and confidentiality and we do not believe that the public interest test outweighs the exemption being applied. The Councils solicitor involved on this matter has provided us with the rationale for this decision.
