1. Under the Freedom of Information act please can you provide details on the remaining duration of the lease.
The contract with places leisure is in year 5 of a 15-year contract.
2. Any financial impact of the early termination of the lease agreement for St Crispins leisure centre between Wokingham Council and or its representative and Places for People Leisure and or its representative? This would include but not be limited to the financial loss and penalties incurred on either side.
Under the FOI Exemptions - Section 43 Part 2 applies as detailed below:
Section 43(2) Information is exempt information if its disclosure under this Act would, or would be likely to, prejudice the commercial interests of any person (including the public authority holding it). This exemption is a qualified exemption and the Council have carried out a Public Interest Test to consider whether the information at this time should be disclosed or not. While the Council wants to adhere to openness and transparency and be accountable for how public money is used, at this time with discussions going on, divulging information at this time could impact on financial aspects. The leisure industry is a competitive market and while any discussion and negotiations are to take place, this would not be sensible to release information that could negatively affect outcomes.
On this basis a response cannot be provided and the exemption is maintained.
