We do not divulge the name of the complainant in complaint case under Section 40 (Personal Information and Section 41 (Information Provided in Confidence) of the FOI Act: Individuals who make complaints, or referrals, expect a certain level of confidentiality when reporting their concerns to the Council. Individuals would be less forthcoming with reporting incidents and concerns to the Council if their details and/or complaint were then released into the public domain which could also place them in a hostile or compromised situation.
