The Council are applying Section 36(2)(b)(ii) to this request. The rationale has been laid out to the Qualified Person who has agreed that maintaining the exemption outweighs the public interest in releasing this information.
The material requested formed part of a set of negotiations between Wokingham Borough Council (WBC) and the Department for Education (DfE) therefore we are applying exemption Section 36 of FOI Act, in order that free and frank discussion between local authorities and the Department for Education can continue.
Some information is required for us to publish and the Safety Valve agreement between Wokingham Borough Council and the Department setting out the key performance actions, are published and already in the public domain: Dedicated schools grant: very high deficit intervention - GOV.UK (www.gov.uk)
WBC has published and will continue to publish information relating to the programme of improvement and investment in services for children with Special Educational Needs and Disabilities setting out aspirations, and expectations resulting from the successful implementation of the reforms where it is able to. There is limited value in publishing large volumes of complex and technical information that will require significant interpretation and further explanation to be understood.
