I would like to make a freedom of information request for correspondence held by the local authority with regard to a planning application for an extension at 23 Chicory Close, application number 212545 and 223535.
1. Can you please supply me with ALL correspondence in relation to my planning application and subsequent correspondence from Ms Castle that relates to this matter, particularly any letters and emails to the parties at [Redacted].
This request is refused under Section 40 of the Act (Personal Details). The information that is being sought relates to communication between the council and another individual other than yourself. A certain expectation of privacy is expected by individuals in that their communication is kept private, this might be different if it were a Councillor acting in their official duty for example. The individual in question is a resident. Section 40 is an absolute exemption and does note require a public interest test.
Individuals are able to seek their own data under a Subject Access, not that of other individuals they lawfully don’t have permissions to access.
