Under the Freedom of Information Act, I would like to request the following information:

1. Does your local authority routinely consider people living with HIV to have a priority need for social housing? We do not routinely have people who disclose that they are living with HIV presenting to our services requesting social housing or homelessness assistance, when we do, we will follow guidance and polices to determine whether they qualify for a higher band for social housing
a) What criteria do you use to determine whether a person living with HIV has a priority need for social housing? We would refer to the Homelessness code of guidance, the Equality Act 2010 and our Allocations policy case law, as well as medical information, information from the applicant and professionals as well as other relevant facts
b) Do you use the MHCLG “Homelessness code of guidance for local authorities” to assess whether a person living with HIV has a priority need for social housing? We use the Homelessness code of guidance to guide and assist us in our decision making to determine what homelessness duties may be owed to an applicant; we use our Allocations policy to determine priority for social housing, which recognises that households who are owed a homelessness duty have an urgent need for housing so are placed in a higher band.

2. Does your local authority have the sufficient time and resources to assess the priority need for social housing of a person living with HIV?

3. Are there further resources or guidance that do not currently exist that would help your local authority assess if a person living with HIV had a priority need for social housing?
