Under the terms of the Freedom of Information act, I wish to make a formal request to see transcript of the anonymous call containing accusations of squalor and neglect, made with regards to [redacted], to the child protection agency. [redacted]

As we are to be investigated, I do not believe this information should be withheld.

This request is refused under Section 40 of the Freedom of Information Act – Personal Details. This exemption is an absolute exemption and there is no public interest test requirement. Freedom of information is a response to the world at large, and any individual should be able to submit and receive the same information. I have considered whether the request should be handled under Subject Access, however, even then this information would not be supplied as is the personal data of the referrer. Any details that can be disclosed will be done so via the Social Care process as the investigation in to the concerns raised are looked in to.

Individuals when raising concerns, complaints, whistleblowing, etc, expect a certain level of protection and that their concerns are raised in confidence. If the Council were to ever release this information then it would impact on our safeguarding duties as no individual would ever want to raise concerns in future knowing that the Council disclosed their details into the public domain and to the individual(s) that they had raised their concerns about.
