Educational Health Care Plans in this case are the legal documents that identify educational, health and social needs and set out the additional support to meet those needs as is the local authority's statutory duty.

Independent special schools under "not for profit" and "for profit" ownership in this case are those registered as specially organised to make provision with pupils for SEN.

Section 41 schools are independent special schools which have been approved by the Secretary of State under section 41 of the Children and Families Act ("CAFA") 2014 as schools which a parent or young person can request to be named in an EHC plan. This means parents or young people have a right to request this type of school is named in an EHC plan in the same way they can request a maintained school.

Special post-16 institutions are legally established to provide education and are not maintained schools or FE colleges. They provide specialist post-16 education and support to young people with some of the most severe learning difficulties or disabilities or low incidence needs.

1. Can you provide data pertaining to the total expenditure incurred by the local authority in placing young people with Educational Health Care Plans at independent special schools (specifically Section 41 schools, other independent special schools and special post-16 institutions) in and out of the borough from September 2022 until September 2023.
This would exceed the appropriate limit. It has been estimated this would take 25 hours worth of work to complete. The outturn figure for INMSS for 2022-23 financial year was £9.7m
