I am writing to request the following information under the Freedom of Information Act (2000), for the following calendar years, broken down by individual year, 2020,2021,2022 and 2023 to date. Please provide the following information:

1. The total number of section 106 obligations that have been amended after a development proposal has been accepted
2. How many of these developments still went ahead, otherwise unchanged
3. The total number of section 106 obligations that have been completely scrapped after a development proposal has been accepted
4. How many of these developments still took place, otherwise unchanged.

We do not keep detailed records relating to some of these questions and would be too time consuming to manually go through all of the agreements to provide a full and detailed response, undertake site visits to check which permission was implemented and check with legal how many and which ones applied to amend but were not successful so proceeded with the agreement as it was. (Section 12)
Attached is a list of deed of variation application that include planning application references alongside the date of the deed of variation for each year in question.
The enquirer can access our website here - Wokingham Borough Council Online Planning and enter the planning reference and search through the documents available should they wish to know the details for each variation. The S106 agreements are usually available to view through the website however if they are not, they can request a copy from our land charges team for a small fee.

5. How much money the council should have received in payments from developers under section 106.
6. How much money the council actually received in payments from developers under section 106.
7. The number of social housing the council originally agreed under section 106 in respect to developments.
8. The number of social houses that were actually built under section 106.

Our annual infrastructure funding statement provides details of S106 financial obligations entered into and details of funds received within a particular year. Details of affordable housing agreed and delivered are also provided. These can be found on our website under Infrastructure funding statement (half way down the page) - Community Infrastructure Levy (CIL) (wokingham.gov.uk) 22/23 will be available from December.
