Location - Loddon Bridge Road at the junction with Headley Road, in Woodley.

I would appreciate if I could have copies of the following

1. Reports of all inspections carried out at the site of the accident since the 20/02/02024, to include but not limited to sketches, recommendations and any repairs conducted at or in close proximity to that Road junction.
A report showing all inspections and details of any repairs carried out at the location, from 20 February 2024 to 8 July 2024, is available as an Excel file with this response. The report has been redacted to remove any personal details, as well as any details not relevant to the enquiry (e.g. street light repairs, repairs at other locations).

2. Any reports by any persons or organisations communicated to the council, directly or through a third party, in respect of damage to the road surface for the road junction in question from the period of the 21/02/2024 to the day of the accident, 08/04/2024. I am led to believe that this pot hole had already been reported approximately one week before the accident.
Reports of highway problems at the location made directly to Wokingham Borough Council from 20 February 2024 to 8 July 2024 are shown under the “Enquiries” section in the attached Excel file. Highway problems are reported via the “Report a problem” page on the Borough’s website at: https://www.wokingham.gov.uk/roads/report

3. All communication in relation to the report made about the existence of the pothole, to include , but not restricted, to all communication, in whatever format, between employees of the council, highways and the insurance firm Gallagher Bassett.
This information is exempt under the Freedom of Information (FOI) Act Section 40 (Personal Information) and Section 41 (Provided in Confidential). This information would be between Wokingham Borough Council and the claimant and would not be disclosable under FOI to be published on our website for the public to view. FOI answers are a response to the ‘world’ in that responses are published into the public domain. Anybody asking for the information under the FOI process should receive the same response.
Communications between the council and its insurer or insurer’s claims handling agents that relate to the conduct of a claim are confidential to those parties. This does not otherwise affect the parties’ obligations to fully disclose information under Part 31 of the Court Procedure Rules and full disclosure has been made.

4. Any other information the council is in possession of which may be relevant and indeed fall in to the rule of disclosure for court purposes.
